The voluntary self-referral disclosure protocol (SRDP) administered by the Centers for Medicare & Medicaid Services (CMS) provides a means through which providers and other parties may self-disclose violations of the federal physician self-referral prohibition commonly known as the Stark Law. Under the SRDP, CMS has the ability to compromise overpayments and resolve overpayments based on Stark Law violations for less than the full amount of the overpayment. Determining whether to submit a CMS self-disclosure requires careful consideration, and navigating the process efficiently and effectively requires a seasoned hand.
